Evolution of the Digital Economy: Framework for Cross-Border e-Commerce, Media Consumption and the Gig Economy

In today’s digital world, one can perform almost all day to day activities online from ordering goods and services, buying tickets, food delivery, to planning your vacation and watching movie on-demand. With the volume of online and social commerce increasing exponentially, these new models are stress testing the old mechanism of regulating trade in the digital economy.

The notion of ‘business operations’, unproblematic for a brick-and-mortar status quo, is ambiguous for a model which operates out of website locations or blended models where eCommerce giants establish physical stores. Cross-border trade in particular, facilitation of goods across borders continues to be challenge. Taxes which focus on domestic consumption are oblivious to the fluid consumption patterns of online buyers.

Gig and crowd sourcing economy are commonly used model of fulfilment. How have existing laws relating to non-traditional arrangements been exacerbated by gig economy practices and how do we define the relationships in the gig economy?

What are the implications of this disconnect for all stakeholders and how can the deficiencies be addressed through more responsive regulatory mechanisms?

This session will engage stakeholders in candid discussion about how businesses are trying to support their rapid growth whilst grappling with the grey areas where there is an absence of a clear regulatory stance.

Wising-up to the Mass Distribution of False Information

Fake news or false information is a specific deleterious outcome arising from the application of intelligent systems to profile users and curate/create content for such users. Increasingly, social media and other platforms are grappling with calls for algorithmic transparency and stricter accountability for how personal data, news and other content are being altered to influence opinion or behaviour. This panel will examine the responsibilities and consequences for different stakeholders, especially on-line intermediaries. It will also debate the extent to which the problem can be effectively solved by laws and regulation. For example, the panel will discuss the merits and limitations of imposing online intermediary liability and immunity having regard to the divergent interests of conduits (carriers) as well as content providers/ platform operators.

Legal Issues in Legal Tech

The Legal Tech Vision maps the universe of Legal Tech into three broad categories. There is a baseline of office automation, communications and productivity software that all modern businesses use, including law firms and legal departments. There is a second category of Legal Tech solutions that are essentially software tools that are designed to assist lawyers in the delivery of their professional services. The third category of Legal Tech solutions start to provide legal information services to clients. As lawyers rely more heavily on technologies to deliver professional services, for example the use of AI in the review of documents and conduct of due diligence, how will this affect their professional responsibilities to clients?

What is the impact when technology shortens the runway for the training of young professionals. But the benefits of technology cannot be denied, particularly from the in-house perspective where solutions to manage templates and monitor compliance alleviate the pressures on a lean legal department. As clients have access to legal information services, how viable are these as a substitute for professional legal advice? This panel will discuss the legal and regulatory issues and broader impact of disruption to the legal services sector.
